$173,000 in fees sought in RI prayer banner case (AP)

PROVIDENCE, R.I. ? Lawyers for the 16-year-old Rhode Island atheist who sued over a prayer banner displayed at a public high school are asking a court to order the city of Cranston to pay $173,000 in attorneys' fees.

The request was filed Tuesday in U.S. District Court in Providence by lawyers retained by the Rhode Island chapter of the American Civil Liberties Union. The lawyers sued Cranston and its school committee on behalf of Jessica Ahlquist, a junior at Cranston High School West.

Earlier this month, a judge ordered the removal of the banner. The school committee has not decided whether to appeal the ruling.

The ACLU says Ahlquist is entitled to $25 in damages. The group also says the $173,000 request does not cover all the time spent on the case.

Japan population seen falling 30 percent by 2060 (Reuters)

TOKYO (Reuters) ? Japan's population is expected to fall by 30 percent to below 90 million by 2060, with two out of every five people 65 or older, a government agency said on Monday, underlining the financial burden looming over the fast-aging society.

The grim forecast underscores the failure of efforts to encourage people to have more babies and will add urgency to efforts on tax and social security reform, and could also stir debate on immigration.

By 2060, the number of people aged 14 or younger is forecast to be less than 8 million while there will be nearly 35 million people aged 65 or older.

The population is aging at the fastest pace among developed countries because of a low birthrate and long life expectancy.

"The trend of the aging society will continue and it is hard to expect the birth rate to rise significantly," Chief Cabinet Secretary Osamu Fujimura told a news conference.

"Thus, comprehensive tax and social security reform is needed."

Prime Minister Yoshihiko Noda has vowed to double a 5 percent sales tax in two stages by October 2015 to help fund bulging social security costs, which are rising by 1 trillion yen ($13 billion) a year and aggravating a public debt already twice the size of Japan's $5 trillion economy.

But the biggest opposition party, although agreeing on the need for a tax increase, is threatening to block legislation in parliament's upper house. The opposition argues that the ruling Democrats' plan to revamp public pensions would require a higher levy than planned.

The population is expected to fall below 100 million in 2048 and dip further to 86.74 million by 2060, from 128.06 million in 2010, according to a projection by a research arm of the Health Ministry.

By 2060, the number of people aged 14 or younger is forecast to fall by more than half, to 7.91 million. By contrast, the number aged 65 or older is seen rising 18 percent to 34.64 million, accounting for 39.9 percent of the population, compared with 23.0 percent in 2010.

The pace of aging has slowed somewhat from the previous estimate made in 2006 but the overall trend has not changed.

"URGENT AND VITAL ISSUE"

The fertility rate, the expected number of children born per couple, is expected to reach 1.35 in 2060 from 1.39 in 2010, below the 2.08 needed to keep the population from shrinking and compared with a global rate of about 2.5.

Some experts have called for the liberalization of immigration rules but many Japanese are cautious about opening the door to foreigners who, many believe, have trouble assimilating in a society where homogeneity has been seen as a source of stability.

Hidenori Suezawa, chief strategist at SMBC Nikko Securities, said the government needed to tackle the sluggish birth rate to help fix the nation's tattered finances and social security system.

"It is necessary to reaffirm that policies to address the low birth rate are an urgent and vital issue," he said in a note.

Japan has been trying for at least two decades to raise the birth rate without success and critics say making it easier for women to work and raise children at the same time is key.

The ruling Democrats promised to beef up childcare allowances when it took power for the first time in 2009 but it has had to revise that pledge because of a worsening fiscal problem.

The population estimate also showed that average life expectancy will rise by more than four years in 2060, to 84.19 for men and 90.93 for women.

The population projection is compiled roughly every five years based on data including a census and demographic statistics and serves as a reference for government social security policy.

Chris Weidman takes UFC on Fox 2 decision

CHICAGO -- On 11 days notice, Chris Weidman took a less-than-stellar split decision over Demian Maia. The judges saw it 29-28, 29-28, 29-28 for Weidman at the United Center on Saturday night.

Though both men are accomplished grapplers, the first round started with nothing but stand-up. Neither fighter truly got an edge in striking, though it was Maia who got the first takedown. The two got back to their feet quickly, and Maia followed up with aggressive strikes.

Weidman got the takedown to start the second round, but again, they did not stay there for long. Maia's face started to show damage from the repeated hits Weidman delivered, but Weidman's movement around the cage slowed as the round went on. As Weidman slowed, Maia delivered more kicks and punches. Weidman tried for a takedown with a minute left, but Maia easily avoided it. In the final 20 seconds, Weidman was able to get the takedown, and turned over for a choke, but the round ended before he could secure it.

Weidman returned to the clinch in the third round, moving towards Maia and landing knees and punches. They continued their evenly matched striking fest, though both fighters were clearly exhausted.

The crowd in Chicago wasn't enthused about the action, but that's what happens when two grappling aficionados decided to engage in a fist fight.

UPDATE: After the bout, UFC president Dana White tweeted that the scores were read wrong. Weidman actually won by a unanimous decision.

Megaupload Users Plan To Sue FBI Over Lost Files

While the FBI went after the file-sharing site for copyright infringement, many users want to recover their non-pirated data.

The drama surrounding file-sharing site Megaupload continued Friday (January 27) as users announced a plan to sue the FBI over files lost during the site's shutdown last week.

Last week, the federal government took action against Megaupload.com, arresting several members of the company on racketeering and copyright-infringement charges. A federal indictment alleged that the site, which allows users to transfer large files, has generated more than $175 million in criminal proceeds and costs copyright-holders more than $500 million in lost revenue from pirated movies, albums and other materials.

According to TorrentFreak.com, Pirate Parties around the world are banding together to file an official complaint against U.S. authorities in an effort to recover the large amounts of non-pirated data, research documents and personal videos that are shared among users on the site.

"The widespread damage caused by the sudden closure of Megaupload is unjustified and completely disproportionate to the aim intended," they announced in a statement obtained by TorrentFreak. "For this reason Pirates of Catalonia, in collaboration with Pirate Parties International and other Pirate Parties, have begun investigating these potential breaches of law and will facilitate submission of complaints against the US authorities in as many countries as possible, to ensure a positive and just result.

"This initiative is a starting point for legitimate internet users to help defend themselves from the legal abuses promoted by those wishing to aggressively lock away cultural materials for their own financial gain."

The Department of Justice said the cast against Megaupload is among the largest criminal copyright cases ever brought by the United States. The news broke just a day after major websites like Wikipedia and Google protested against the U.S. House of Representatives' controversial Stop Online Piracy Act, or SOPA, and the Senate's similar Protect IP Act.

Why is Egypt barring 6 Americans from leaving? (The Week)

New York ? Egypt clamps down on U.S. groups promoting democratic reforms ? potentially endangering the $1.3 billion in U.S. aid the Egyptian army gets each year?

Egyptian authorities have put six Americans ? including Sam Lahood, the son of Transportation Secretary Ray LaHood ? on a no-fly list, preventing them from leaving the country. The move is part of a crackdown by Egyptian security forces on Washington-backed groups that promote democracy and human rights. Egypt's military leaders, who took over after protesters pushed aside longtime leader Hosni Mubarak last February, say they want to lead a transition to democracy and hand over power to an elected president this summer. What do they hope to accomplish by provoking the U.S. so overtly? Here, a brief guide:

Who are the Americans being targeted by Egypt?
They work for nongovernmental organizations (NGOs) that promote human rights and civil institutions needed to build a democracy. The groups also helped monitor the country's recent parliamentary elections. Egyptian security forces last month raided the offices of 17 such NGOs, including the Washington-based International Republican Institute (IRI), National Democratic Institute, and Freedom House. Sam LaHood is the IRI's director in Egypt. He tells The New Yorker that when police barged into his office, they confiscated computers, documents, and "every stick of furniture, even book shelves."

Why are Egypt's leaders singling them out?
The government has given no official reason, although the travel ban appears to be linked to an investigation stemming from the raids. But clearly,?says John Bresnahan and David Rogers at?Politico, this is part of a?"power struggle between the United States and Egyptian governments over the country's future direction."?The generals, perhaps hoping to rekindle resentment against the U.S. for its ties to Mubarak, have accused "foreign hands" of stirring up protests against their rule. The NGOs "are being targeted because they revealed a lot of crimes and flawed interactions that have been carried out in the transitional phase," Hesham Genene, head of the Cairo Appeals Court, tells TIME, "and their voices keep getting louder and louder."

Is that the only reason?
Probably not. The U.S. government spends hundreds of millions of dollars on the civil-society programs these NGOs work on, along with more direct aid projects like sanitation and health. Before protesters drove out Mubarak, the U.S. aid was funneled through the government. Now the money goes directly to the NGOs. That, LaHood says, might have made some Egyptian officials mad. "It didn't really matter what the money went for," he tells The New Yorker. "It just wasn't going through their bank accounts."

Will provoking the U.S. backfire?
It certainly could. The Egyptian Army gets $1.3 billion a year in U.S. aid, and Sen. John McCain (R-Ariz.), who has a hand on the purse strings as chairman of the Senate Armed Services Committee, also happens to be chairman of the IRI.?"The amplified pressure on NGOs could be a gamble,"?says Abigail Hauslohner at?TIME. "The move may well anger members of Congress more than it sways them to the military's side."

Planet looks back at the northern lights

The skies are settling down after this week's big solar storm, leaving behind a gallery of green-glowing pictures as a lasting legacy.

For a time on Tuesday, the solar radiation levels registered as the highest in more than eight years, but the most significant impact came in the form of shifts in airline routes to avoid polar disruptions in communications. Strong solar storms have the potential to disrupt electrical grids and satellite operations, but no big problems were reported on those fronts this week.


"Conditions are now beginning to trend back toward quiet levels," the experts at the National Oceanic and Atmospheric Administration's Space Weather Prediction Center reported today. By Thursday, geomagnetic activity is expected to be back down to background levels.

The bright northern lights associated with the storm wowed observers in Scandinavia, Iceland and Greenland, but the show "petered out almost completely by the time it reached North America," SpaceWeather.com's Tony Phillips reported. Oh, well. At least we have the?photographs captured by those who did get in on all the fireworks.

One of the most unorthodox views comes from G?ran Strand of ?stersund, Sweden, who took a panoramic photo of the northern lights and wrapped?the sights?into a 360-degree composition titled "Planet Aurora." The picture?shows?a photographer standing on a snowy circle, with trees bristling around the edge and ripples of red and green light glowing in the surrounding sky.

"Me and a friend went out to capture the beauty, and what a show it was," Strand told SpaceWeather.com. "I made two panoramas of my friend while he was taking pictures." Royal Ballet star's resignation shocks dance world

(AP) ? The ballet world is spinning after one of the art's brightest stars walked away from Britain's Royal Ballet without explanation, days before he was due to take the lead in a new production.

Ukrainian dancer Sergei Polunin announced this week that he is quitting immediately. He had been due to open as Oberon in "The Dream" next week.

The 21-year-old studied dance in Kiev before attending the Royal Ballet School in London from the age of 13.

He has thrilled audiences since he became the company's youngest-ever male principal dancer at the age of 19. His poise, muscularity and gravity-defying leaps have brought comparisons with the young Rudolf Nureyev and Mikhail Baryshnikov.

Royal Ballet director Monica Mason said Polunin's resignation had "come as a huge shock."

"Sergei is a wonderful dancer and I have enjoyed watching him tremendously, both on stage and in the studio, over the past few years," she said in a statement. "I wish him every success in the future."

Ballet websites swirled with speculation about the motive for Polunin's sudden departure. Some suggested the dancer ? who co-owns a London tattoo parlor ? might have grown frustrated with the strict discipline of the ballet life.

In an interview last year, he referred to the pressure he felt to succeed.

"I would have liked to behave badly, to play football. I loved sport," he told The Guardian. "But all my family were working for me to succeed. My mother had moved to Kiev to be with me. There was no chance of me failing."

Others suggested Polunin might have been poached by a rival company, there was no word from the dancer.

Adult stem cells could improve angioplasy outcome; Study to explore usage

ScienceDaily (Jan. 23, 2012) ? A Creighton University School of Medicine researcher has received a $3.3 million, five-year grant from the National Institutes of Health to study what role adult stem cells might play in repairing damaged coronary arteries, a complication that often occurs in patients after they undergo angioplasty and stenting.

"Restenosis, a re-narrowing of coronary arteries in the heart, after balloon angioplasty and the placement of stents, is a serious problem. Drug-eluting stents can help reduce the occurrence of restenosis. However, there is a serious tradeoff.

Drug-eluting stents can lead to thrombosis (platelet deposits in the endothelial lining around the blood vessels that destroy the lining), which then requires longer periods of anti-platelet therapy. This therapy, in turn, can produce serious side effects, including nosebleed, upset stomach, nausea and diarrhea," said Devendra Agrawal, Ph.D., principal investigator and a professor of biomedical sciences, internal medicine and medical microbiology and immunology.

For the study, Agrawal and his co-investigators, Creighton cardiologist Michael Del Core and pathologist William Hunter will deliver adult stem cells (autologous mesenchymal stem cells), together with a novel gene, at the site of an interventional procedure in the coronary arteries of a pig model.

The goal is to determine whether the administration of adult stem cells, along with the gene therapy, is superior to using drug-eluting stents following angioplasty, said Agrawal, holder of The Peekie Nash Carpenter Endowed Chair in Medicine. If successful, he added, the treatment could even eliminate the need for stents.

Recent research has shown that angioplasty and stenting -- commonly used to open narrowed coronary arteries -- are not as effective as once thought.

In fact, a study involving more than 15,000 patients and published Nov. 28 online by the Archives of Internal Medicine, shows that it can even do more harm than good in some patients. According to the study, nearly one in 10 patients undergoing coronary angioplasty was readmitted to a hospital within 30 days, and these patients were at higher risk of death within one year.

With angioplasty, a catheter-guided balloon is inserted to open a narrowed coronary artery. A wire mesh stent is typically implanted during the procedure to keep the artery open.

Eleven to18 percent of all patients experience restenosis or a re-narrowing of the artery within three-four years, said Agrawal.

This is the second grant Agrawal has received in recent months to explore alternatives to stenting. The first grant totaled $2.58 million over four years.

We saw plenty of the Xperia S before it officially surfaced at CES, and we've already seen leaked photos of the MT27i "Pepper", along with a purported leaked roadmap for other Sony phones. Today, though, XperiaBlog has the first image of at what is reportedly the Sony (Ericsson) ST25i "Kumquat", a mid to high-end Android phone with a 3.5-inch display and a familiar industrial design.

The "Kumquat", which according to the leaked roadmap is due this April at a ~€260 price point, is apparently powered by a 1GHz dual-core processor, with a 5MP camera and a qHD (960x540) display. If the rumored specs and price are correct -- and admittedly that's still a pretty big "if" -- this device could be very tempting for those looking for a smaller, more portable smartphone with high-end specs.

Hopefully we'll see more of the "Kumquat" at Sony's Mobile World Congress presentation in just a few weeks, where the manufacturer looks set to reveal more of its 2012 line-up.

What Gadgets Can an iPad Replace? (ContributorNetwork)

Apple's iPad is starting to replace desktop and laptop computers, for a lot of people. Its success tracks closely with declining PC sales at vendors like HP and Dell, and if you count it as a computer it makes Apple the world's top PC vendor, according to Todd Wasserman of Mashable.

How can the iPad replace laptops and desktop PCs? As Matthew Guay of Techinch put it, the iPad is like the microwave oven of computers. It can't do everything a full PC or Mac can, but it can do most things, and it does them with a lot less time and hassle. Besides that, iPad games and apps cost much less than their PC counterparts. The iPad version of iWork, for instance, costs half as much as the Mac version.

Here's a look at some other things people are using their iPads instead of now:

Game consoles

Nintendo considers itself to have won against Sony, but considers Apple the "enemy of the future," as Chris Rawson of TUAW explains. And while Nintendo made record sales on Black Friday, part of the reason was that it'd already dropped the price of its portable 3DS game console by $80 beforehand.

There are still a ton of games you can only play on Nintendo consoles, like the official games for the Mario, Zelda, and Metroid franchises. (Don't forget about Pokemon, either. The latest installments in the series, Pokemon Black and Pokemon White, sold more than 1 million copies in the U.S. within just 24 hours of launch day.)

The iPad has literally thousands of games available, though, including iOS exclusives from top-tier publishers like Square-Enix. So while it can't replace a DS for a Pokemon addict, there are probably a lot of game consoles collecting dust because of it.

E-readers

The Kindle Fire and Nook Color (and Tablet) are all selling extremely well, at least compared to generic-brand "Android tablets". And David Heinemeier Hansson, the creator of Ruby on Rails, has noted that a black-and-white e-reader "rekindled" his interest in reading books.

The iPad doesn't exactly compete with the Kindle Fire or the Nook, because they're at different price points. But the iPad does everything they do, and has thousands more apps.

Textbooks

They aren't gadgets, but with the prices on some of them they might as well be; a new college textbook can cost as much as a Kindle Fire or Nook. And now Apple's new iBooks Author program may drop the price of electronic textbooks to $14.99, if you buy them on an iPad.

Not all textbooks are available on an iPad yet, but with publishers like McGraw-Hill signing on already that may change soon.

(AP) ? Penn State's embattled Board of Trustees meets Friday for the first time since the chaotic week in November when shocking child sex abuse allegations were brought against a retired assistant football coach.

In the frantic first few days after authorities charged Jerry Sandusky, trustees ousted Hall of Fame coach Joe Paterno and school President Graham Spanier, and pledged to uncover the truth. Their actions have since left some anguished alumni and former players questioning the trustees themselves.

After remaining mostly silent the last two months, trustees this week began to divulge the reasons behind their actions, hoping to sway skeptics and critics seeking change.

Leadership positions will be up for election at Friday's meeting. Also listed on the agenda is an overview of athletic programs.

"We have lots of things that we need to do in terms of the board and how it operates, and I think you'll see some positive things come out of that," trustee Mark Dambly said Thursday.

Some critics of the trustees have called for wholesale changes in how the board operates in order to better promote transparency. Trustee Stephanie Deviney said governance and the administration are among the topics trustees plan to consider.

The issues have also drawn unprecedented interest among potential candidates for three alumni-elected seats on the board up for a vote this spring.

Typically, about six to 12 candidates express interest. But the group Penn Staters for Responsible Stewardship alone has received 30 applications seeking an endorsement. The group started in mid-November, growing out of what a spokeswoman said was a common frustration among members over a lack of due process at the school.

Comments this week by the trustees about why the board ousted Paterno on Nov. 9, four days after Sandusky was charged, failed to convince the alumni group, too.

Trustees interviewed Thursday by The Associated Press said they decided to force Paterno out in part because he didn't meet a moral obligation to do more to alert authorities about a child sex abuse allegation against Sandusky.

The trustees interviewed also cited statements from Paterno in the days and hours leading to his dismissal ? after nearly a half-century of leading the Nittany Lions ? that they felt challenged the trustees' authority. Board members saw that as inappropriate, particularly at a time of intense scrutiny over the Sandusky case.

Sandusky was charged with dozens of child sex abuse counts four days before Paterno was pushed out. The head coach had testified before a state grand jury about a 2002 allegation against Sandusky that was passed on to him by a graduate assistant.

A day after the graduate assistant, Mike McQueary, came to see him, Paterno relayed the accusations to his superiors, one of whom oversaw campus police. Board members didn't think that was enough.

"There's an obligation, a moral responsibility, for all adults to watch out for children, either your own or someone else," Dambly said. "It was in our opinion that Joe Paterno did not meet his moral obligation and for that reason ? me, personally for that reason, I felt he could no longer lead the university and it was unanimous."

But Dambly and three other trustees interviewed Thursday on the Penn State campus said they still intended to honor Paterno's accomplishments and contributions to the school. He won a Division I record 409 games over 46 seasons and the Paterno family has donated millions of dollars to the school.

"Obviously Joe Paterno is a worldwide icon and has done a tremendous amount for the university," trustee Joel Myers said. "We have sorrow and all kinds of emotions, empathy, sympathy for what has occurred. That's universal.

"But the university, this institution is greater than one person."

An attorney for Paterno on Thursday called the board's comments self-serving and unsupported by the facts. Paterno fully reported what he knew to the people responsible for campus investigations, lawyer Wick Sollers said.

"He did what he thought was right with the information he had at the time," Sollers said.

In a separate statement, Penn Staters for Responsible Stewardship said the board's comments have "done nothing but raise additional questions."

"We can conclude, that consequently, their hasty and panicked damage control efforts in the first days of November, and the uncomfortable position they found themselves in, being caught flat-footed, instead of in a proactive leadership position, led to the unjust firing of Joe Paterno, without so much as a conversation, let alone complete due process," the group's statement said.

The trustees described the long deliberations in the days leading up to Paterno's ouster as emotional and nerve wracking, echoing the confusion and anguish also felt among students and alumni as the scandal unfolded. They were shocked by the lurid details that had emerged about the case that week, after having been given a short briefing about Sandusky months earlier by Spanier and general counsel Cynthia Baldwin. That session lasted roughly 7 minutes and provided few insights, trustees said.

Paterno was dismissed the same day Spanier also departed under pressure. The board initiated an internal investigation into the Sandusky case and the role of Penn State officials.

Since then, some alumni and former players have been questioning the actions of the trustees ? criticism that boiled over in three town hall-style meetings last week hosted for alumni by new school President Rodney Erickson.

According to Dambly, trustees had been advised not to speak because of the ongoing investigations but changed their minds following the town hall sessions.

They began a series of interviews this week with media outlets. Also sitting in Thursday's interview with the AP was Lanny Davis, a prominent Washington attorney who has been retained by Erickson and the trustees as an adviser.

"We determined as a group that the Board of Trustees needed to answer the questions of what we knew, when we knew it and why we made the decisions that we made," Dambly said.

The trustees on Thursday cited three reasons for Paterno's immediate removal as head coach. Besides the moral obligation to do more in conjunction with reporting the 2002 allegation and statements issued by Paterno they felt may have challenged trustees' authority, the trustees also said there was concern that Paterno would not be able to properly represent the school if allowed to stay on as head coach the rest of the 2011 season.

According to The Washington Post, trustees vice chair John Surma told Paterno, "In the best interests of the university, you are terminated." Paterno hung up and repeated the words to his wife, who redialed the number.

"After 61 years he deserved better," Sue Paterno said. "He deserved better." Then she hung up.

According to Davis on Thursday, Surma never got the chance to say two more things that night: that he regretted having to tell him the decision over the phone; and that the school was going to honor his contract and retirement package as if he had retired at the end of 2011.

Dambly insisted Paterno was not fired, although he never appeared as coach again. He remains a tenured faculty member.

The groundbreaking plan to photograph a black hole (The Week)

New York ? Scientists want to build an enormous "virtual telescope" capable of taking a picture of a massive black hole 26,000 light years away

How do you take a picture of a black hole, a celestial object so dense it gobbles up light with its monstrous gravitational pull? An ambitious group of determined scientists will convene this week to discuss a project called the Event Horizon Telescope, with the goal of photographing a supermassive black hole deep in the heart of our Milky Way galaxy ? the first such snapshot ever. "Even five years ago, such a proposal would not have seemed credible," says MIT's Sheperd Doeleman, the project's lead researcher, in a press release. "Now we have the technological means to take a stab at it." Here's the plan:

First off: What exactly is a black hole?
It's a "place in space where gravity pulls so much that even light cannot get out," says NASA. Black holes are often created by the death of a star, when an immense amount of matter is squeezed into an impossibly smaller space, drastically strengthening gravity's pull. Some black holes are as tiny as a single atom ? others have a mass equivalent to millions of stars.

Why is it so hard to photograph a black hole?
Since no light can get out, black holes are invisible. Scientists can only?hope to catch a glimpse of a black hole's "shadow,"?says Space.com. "As dust and gas swirls around the black hole before it is drawn inside, a kind of cosmic traffic jam ensues," notes Doeleman ? like water draining in a bathtub.?That "shadow" is known as a black hole's "event horizon" ? and it can be photographed.

Are there other obstacles?
There sure are. Though the black hole that Doeleman and Co. want to photograph is estimated to be four million times bigger than our sun, it is "extremely compressed and far away," says Irene Klotz at Discovery News ? about 26,000 light years from Earth. "To astronomers, it's like looking at a grapefruit on the moon."?

So... how do you take a photo of it?
Scientists would need an "enormous" telescope with a mirror as large as a planet,?says Travis Korte at The Huffington Post. Obviously, constructing a single telescope that big and powerful isn't possible. So the Event Horizon Telescope would combine the networked viewing power of some 50 telescopes from all over the globe, from Hawaii to the South Pole. "In essence," says Doeleman, "we are making a virtual telescope with a mirror that is as big as the Earth."?

Audio: Cruise captain pleaded not to reboard ship (AP)

ROME ? Five more bodies were pulled Tuesday out of the crippled cruise ship off Tuscany, and a shocking audio emerged in which the ship's captain was heard making excuses as the Italian coast guard repeatedly ordered him to return and oversee the ship's evacuation.

Prosecutors have accused Capt. Francesco Schettino of manslaughter, causing a shipwreck and abandoning his ship before all passengers were evacuated during the grounding of the Costa Concordia cruise ship Friday night.

The death toll nearly doubled to 11 on Tuesday when divers located five more bodies, all of them adults wearing life jackets, in the rear of the ship near an emergency evacuation point, according to Italian Coast Guard Cmdr. Cosimo Nicastro. He said they were thought to have been passengers.

Prior to the discovery of the five bodies, the coast guard had raised the number of missing to 25 passengers and four crew. Italian officials gave the breakdown as: 14 Germans, six Italians, four French, two Americans, one Hungarian, one Indian and one Peruvian.

But there was still confusion over the numbers, and the German Foreign Ministry in Berlin listed 12 Germans as confirmed missing.

The Costa Concordia was carrying more than 4,200 people when it hit a reef off the Tuscan island of Giglio when Schettino made an unauthorized deviation from the cruise ship's programmed course, apparently as a favor to his chief waiter, who hailed from the island.

Schettino has insisted that he stayed aboard until the ship was evacuated. However, a recording of his conversation with Italian Coast Guard Capt. Gregorio De Falco that emerged Tuesday indicates he fled before all passengers were off ? and then resisted De Falco's repeated orders to return.

"You go on board and then you will tell me how many people there are. Is that clear?" De Falco shouted in the audio tape.

Schettino resisted, saying the ship was tipping and that it was dark. At the time, he was in a lifeboat and said he was coordinating the rescue from there.

De Falco shouted back: "And so what? You want to go home, Schettino? It is dark and you want to go home? Get on that prow of the boat using the pilot ladder and tell me what can be done, how many people there are and what their needs are. Now!"

"You go aboard. It is an order. Don't make any more excuses. You have declared 'Abandon ship,' now I am in charge," De Falco shouted.

Schettino was finally heard agreeing to reboard on the tape. But the coast guard has said he never went back, and had police arrest him on land.

The 52-year-old Schettino, described by the Italian media as a genial, tanned ship's officer, has worked for 11 years for the ship's owner and was made captain in 2006.

Schettino hails from Meta di Sorrento, in the Naples area, which produces many of Italy's ferry and cruise boat captains. He attended the Nino Bixio merchant marine school near Sorrento.

A judge is to decide Tuesday if Schettino should stay jailed, as requested by prosecutors. He could face up to 12 years in prison on the abandoning ship charge alone.

Earlier Tuesday, Italian naval divers exploded holes in the hull of the grounded cruise ship, trying to speed up the search for the missing while seas were still calm. Navy spokesman Alessandro Busonero told Sky TV 24 the holes would help divers enter the wreck more easily.

"We are rushing against time," he said.

The divers set four microcharges above and below the surface of the water, Busonero said. Television footage showed one hole above the waterline less than two meters (6 feet) in diameter.

"The hope is that the ship is empty and that the people are somewhere else, or if they are inside that they found a safe place to await rescue," Coast Guard spokesman Filippo Marini told Sky TV 24.

Mediterranean waters in the area were relatively calm Tuesday with waves of just 12 inches (30 centimeters) but they were expected to reach nearly 6 feet (1.8 meters) Wednesday, according to meteorological forecasts.

A Dutch shipwreck salvage firm, meanwhile, said it would take its engineers and divers two to four weeks to extract the 500,000 gallons of fuel aboard the ship. The safe removal of the fuel has become a priority second only to finding the missing, as the wreckage site lies in a maritime sanctuary for dolphins, porpoises and whales.

Smit, a Rotterdam, Netherlands-based salvage company, said no fuel had leaked from any of the ship's tanks and that the tanks appeared intact. While there is a risk the ship could shift in larger waves, to date it has been relatively stable perched on top of rocks near Giglio's port.

Smit's operations manager, Kees van Essen, said the company was confident the fuel could safely be extracted using pumps and valves to vacuum the oil out to waiting tanks.

"But there are always environmental risks in these types of operations," he told reporters.

Preliminary phases of the fuel extraction could begin as early as Wednesday if approved by Italian officials, the company said.

The company said any discussion about the fate of the ship ? whether it is removed in one piece or broken up ? would be decided by Italian ship operator Costa Crociere and its insurance companies.

The Miami-based Carnival Corp., which owns the Italian operator, estimated that preliminary losses from having the Concordia out of operation at least through 2012 would be between $85 million and $95 million, along with other costs. The company's share price slumped more than 16 percent Monday.

It was not yet clear if the ship ? which was completed in 2006 ? would ever be able to return to service.

Carnival said its deductible on damage to the ship was approximately $30 million. In addition, the company faces a deductible of $10 million for third-party personal injury liability claims.

Carnival said other costs related to the grounding can't yet be determined.

Sahar Gul, Tortured Afghanistan Girl, Wants In-laws Jailed

KABUL, Afghanistan -- A 15-year-old Afghan girl who was tortured for months after her arranged marriage has spoken out for the first time since her rescue, saying she hopes her husband and his family are jailed for her abuse.

Sahar Gul became the bruised and bloodied face of women's rights in Afghanistan after she was rescued in late December when an uncle called police.

Speaking in an interview Saturday from a hospital in Kabul, Gul blamed her husband, his parents and his sister for her ordeal.

"I want them to be in jail," she said. "They gave me electric shock. ... They beat me with cables and tortured me."

She is being treated for multiple injuries that include broken fingers and ripped-out fingernails.

Police in Baghlan province where Gul was rescued have said her in-laws locked her up and tortured her after she refused to work as a prostitute. Her husband's parents and sister have been arrested. They deny any wrongdoing.

Authorities have issued an arrest warrant for her husband, who serves in the Afghan army.

Her doctor, Feriba Omarzada, said Gul is recovering but is still traumatized.

Guls' story has shocked Afghanistan and prompted calls for more efforts to end underage marriage. The legal marriage age in Afghanistan is 16, but the United Nations agency UN Women estimates that half of all girls are forced to marry under age 15.
